These Terms describe the agreement Errly will enter with customers when the service launches. They are published here ahead of launch so that procurement teams can review the shape and substance in advance. This document is not yet legally binding; it will be given an effective date when the service launches and the first paying customer signs up.
01The agreement
These Terms of Service govern access to and use of the Errly service operated by AES Tech AB (Org. nr. 559507-2157, Stockholm, Sweden). By creating an account or using the service, you agree to these terms on behalf of yourself or the entity you represent ("Customer").
02Account & access
Access is via magic-link authentication; passwords are not used. Customer is responsible for maintaining the security of mailbox addresses associated with the account and for any actions taken through it. DSN secret keys issued to Customer projects are confidential and may be rotated from project settings at any time.
03Acceptable use
Customer must not transmit Service Data containing payment card data (PCI-DSS scope), special-category personal data under Article 9 GDPR (including health, biometric, or genetic data), or content that is unlawful in the European Union or in the Customer's own jurisdiction. Customer is responsible for configuring PII scrubbing on the SDK side for any payloads that may include personal data of Customer's end-users.
04Service availability
Errly targets 99.9% best-effort uptime, measured monthly, excluding scheduled maintenance announced at least seventy-two hours in advance. Errly does not currently offer service-level agreements with credit or refund mechanisms; the published target is the uptime commitment.
05Fees & taxes
Subscription fees are charged through Stripe Payments Europe Ltd. EU VAT is calculated and collected via Stripe Tax. Fees are denominated in Euros and billed monthly or annually in advance. Unpaid invoices may result in suspension after a fourteen-day grace period.
06Liability
To the maximum extent permitted by Swedish law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly. Each party's total liability arising out of or related to these Terms is limited to the fees paid by Customer to Errly in the twelve months preceding the event giving rise to liability.
07Confidentiality
Each party will protect the other's Confidential Information using at least the same degree of care it uses to protect its own confidential information, and in no event less than reasonable care. Service Data is Customer's Confidential Information.
08Termination
Either party may terminate the agreement with thirty days' notice for any reason, or immediately for material breach not cured within thirty days of written notice. On termination, Customer's Service Data will be returned or deleted in accordance with the DPA.
09Governing law
These Terms are governed by the laws of Sweden. Disputes shall be resolved by the Stockholm District Court (Stockholms tingsrätt) as court of first instance, without prejudice to mandatory consumer-protection rules in Customer's jurisdiction.
